Please read these terms and conditions carefully as they contain very important information about booking a travel product and/or service with GetAway Travel Group, LLC 

Health & Safety Tips for Travelers
We strongly recommend that you visit the U.S. Department of State website travel.state.gov, as well as the Centers for Disease Control and Prevention website, cdc.gov, which include important information on foreign travel such as travel advisories, warnings and restrictions issued by the U.S. government. You are responsible for complying with the health requirements of the countries you intend to visit. Check with your physician regarding any immunizations that may be recommended or required. Use common sense while vacationing abroad. For example, if you choose to drink alcohol, do so in moderation. In addition, be cognizant of the effects of mixing alcohol and certain medications. Should someone in your party become ill, alert the resort front desk for immediate medical attention or call the emergency number provided by the resort. Also advise your Resort Representative as soon as possible, who may be able to provide assistance. If you have medical issues or concerns about medical services, we urge you to contact your resort with specific questions. Please be aware that medical standards and training of emergency responders and resort medical facilities vary greatly, and health care abroad may not be the same as you might expect at home. It may be standard policy for hospitals and medical providers abroad to require cash payment upfront for services. Check with your insurance provider regarding claims for reimbursement. Sports and aquatic equipment, especially scuba gear, may not meet U.S. safety standards and many resort pools and beaches may lack lifeguards. Balcony railing heights in Mexico are lower than the mandated heights in the United States, and also may be lower in other countries. Low balcony railings create a risk of falls, which may result in serious injury or death. Bottled drinking water is recommended. By offering for sale travel to particular destinations, GetAway Travel Group does not represent or warrant that travel to such destination is without risk and is not liable for any damages or losses that may result from travel.

Covid -19 Notice

The 2019 Novel Coronavirus* (COVID-19, “Coronavirus”) is a known and rapidly evolving pandemic that is affecting travel worldwide, with continued spread and impacts expected. Client is fully aware of the current global Coronavirus COVID-19 virus outbreak, the current travel restrictions, and inherent risks involved if choosing to travel. 
 Client understands that it is his/her responsibility to check the latest travel information regarding this virus outbreak with the CDC. https://wwwnc.cdc.gov/travel/notices  
Client understands that it is his/her responsibility to have travel insurance to ensure they have coverage for all medical needs and trip cancellation but understands that concerns or fear of travel is not a covered reason for cancellation relating to the Coronavirus/ COVID19 and will be denied. Client understands that he/she is bound by the terms of the insurance policy as it relates to Coronavirus/COVID-19. Client holds harmless for his election to not purchase travel insurance or any denial of claim by travel insurer, including but not limited to monetary losses, as it relates to COVID-19 or any other claim under the policy.  
Travel insurance generally only covers unforeseen events. Most insurers classified COVID19 as a 'known event' late January 2020. Most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place Client is aware of the travel warnings, travel restrictions and rules and understands the risks, therefore, accepting these risks, holds and the travel advisor, harmless for any travel restrictions, death, illness, cancellations by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider, financial loss, quarantining rules or measures put in place at airports or govern entities on the destinations you are traveling through. Client further agrees to hold harmless for any financial penalties or fees imposed by the by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider due to cancellations or postponements due to COVID-19 and agrees not to institute a credit card dispute or “charge back” to for said penalties or fees. 
Client is aware that additional screening procedures and restrictions may take place at airports and in public areas. Client is aware that these restrictions may include mandatory face coverings and/or temperature checks in airports, hotels, cruise ships, trains, or other means of transport. Client is aware that Immigration restrictions may be put in place before or during your travels that may impede your ability to enter or exit your destination as planned. Self quarantine of a minimum of 14 days may be required by some destinations upon arrival. Client is aware that it is his/her personal decision to travel and is doing so with full knowledge of current travel recommendations and travel restrictions with regards to the Coronavirus COVID-19 and takes full responsibility for his/her actions with regards to this. 

Hazardous Materials Restrictions and Insecticide Notice
Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radioactive materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals. There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. Special restrictions and limitations for transporting Hazardous Materials and specifically Lithium Ion batteries, refer to www.faa.gov/go/packsafe for more information. In the event a carry-on bag cannot be accommodated in the passenger cabin and has to be placed below in a cargo bin for any reason, any electronic device or spare Lithium-ion or any other type of battery permitted in carry-on baggage MUST be removed from the carry-on bag and remain in the possession of the passenger in the passenger cabin. For further information, contact your airline representative. Some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. Air Carriers
We have made arrangements for air transportation to your vacation destination via regularly scheduled certificated air carriers or other air carriers who have duly filed with and are authorized to operate air transportation and public charter transportation by the U.S. Department of Transportation. We reserve the right to substitute alternate air carriers if necessary. All air travel is subject to the terms and conditions of the operating air carrier. When you fly to and from your destination the Conditions of Carriage apply, some of which limit or exclude liability. The Conditions of Carriage are available by requesting them in writing from the carrier or by request at the airport.

 

Flights & Airport Check-in
Your flight information will appear on the booking confirmation issued when you make your deposit, and on your electronic travel documents issued upon full payment. All flight times are subject to change without notice. We strongly suggest that you reconfirm exact flight times with the carrier 24 hours prior to departure and again before departing for the airport. For international flights, we recommend arriving at the airport at least three hours prior to your scheduled departure time to allow time to check in and get through Security. For domestic flights, we recommend that you arrive two hours prior to travel but absolutely no later than one hour prior to travel. If you do not have pre-assigned seats and have seat preferences, we recommend that you arrive early as seats will be assigned upon check in based on availability. Pre-assigned seat selection is at the discretion of the air carrier and may require payment of an additional fee.

If you do not check in at the airport or gate at the required time, or do not possess proper documentation, you will be denied boarding and will not be eligible for a refund. Additionally, if you fail to check in for your flight without prior cancellation, you are considered a no-show and will not be eligible for a refund. Travel Insurance does not cover the instances noted above. GetAway Travel Group assumes no responsibility for any passengers making independent connections to flights booked through GetAway Travel Group. Some airlines do not charge for infants under two years of age, but the infant must sit on an adult’s lap. Other airlines do charge for infants or infant air-related taxes. Please check with your air carrier. If an infant reaches the age of two at any time during the vacation, federal law requires the purchase of a separate seat for any remaining portions of the flight. Some countries charge infant departure taxes.

 

Denial of Entry
Certain countries may deny entry to travelers with even a minor criminal record, and if not a U.S. citizen, entry back into the U.S. Check with the U.S. Embassy and the embassy or consulate of the country being visited to ensure you can travel as planned. GetAway Travel Group does not accept responsibility if you are denied entry and cancellation penalties apply.

 

Traveling Minors
We cannot accept unaccompanied minors under 18 for any travel. For certain countries, a notarized consent from both parents or legal guardian(s) is required for children younger than 18 years old traveling with one parent, or in someone else’s custody; or a notarized birth certificate showing only one parent, a parent’s death certificate, or a court order of child custody MAY also be permissible. Be sure to inquire with your destination‘s consulate, or visit websites such as travel.state.govdhs.gov or iatatravelcentre.com. Mexican-born minors under 18 years of age traveling alone or with someone other than a parent or legal guardian, require special documentation to depart Mexico, even if the Minor is a Dual Mexican Citizen. Some airlines may require documentation for children traveling without their legal guardian beyond what is mandated by the destination country- contact your airline directly for details.

 

Required Entry/ Re-entry Documentation
Proper documentation is YOUR responsibility. The following information is based on current requirements for U.S. citizens at time of publication. This information may change- see your travel agent or contact your destination consulate for the most current requirements on your travel date. Passengers returning to the U.S. by air from any international destination must have a valid passport, and may be denied boarding by the airline if the passport is damaged, mutilated, or has excessive wear. A “Passport Card” is not acceptable. If your name on your passport (or for non-U.S. citizens, “valid travel documents”) does not match your name on your travel documentation, you will not be allowed to travel. A passport valid for up to 6 months past the date of completed travel is required when traveling internationally. Married or divorced women traveling under names other than what is printed on their travel documents must supply a marriage license and/or divorce decree. For details on how to obtain a passport, contact your local courthouse or post office. If you are not a U.S. citizen, contact your destination’s consulate or embassy to determine required entry documents.


Passports are NOT required for travel within the continental U.S., Hawaii, Puerto Rico, and the U.S. Virgin Islands. However, travel to these U.S. destinations/ U.S. territories requires a valid state/government-issued picture I.D. or valid state-issued driver’s license that is compliant with the Real ID ACT. Passed by Congress in 2005, the REAL ID Act established minimum ID security standards and prohibits federal agencies, like TSA, from accepting licenses and identification cards for official purposes from states that do not meet these standards. Passengers traveling domestically with a driver’s license issued by a state that is not compliant with the REAL ID ACT (and has not been granted an extension) will need to show an alternative form of acceptable identification for domestic air travel to board their flight. To check whether your state is compliant or has an extension, visit dhs.gov/real-id. If your state-issued ID or driver’s license is not compliant, visit tsa.gov/travel/security-screening/identification for alternate forms of acceptable ID. Due to COVID-19, the deadline for domestic airline passengers to secure a Real ID driver’s license for use as identification at the airport has been moved back one year. Enforcement is now due to begin on October 1, 2021. Any passenger who is denied boarding due to lack of proper documentation will have their vacation cancelled. Failure to comply with the above requirements will result in you not being allowed to travel and no refund will be given.

 

Travel Documents
Your travel documents will be emailed to you once full payment is received. Please check them carefully to ensure that all the information is correct and passenger names exactly match your Proof of Citizenship. If you discover an error, please contact your travel agent immediately.

 

Force Majeure

GetAway Travel Group, its parent, subsidiaries, affiliates, agents, subagents, suppliers and each of their respective officers, directors, employees, agents and representatives will not be responsible or liable for any loss, damage or injury of any nature and of any kind in whole or in part resulting from a force majeure condition including without limitation: act of God, fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, flood, water or power shortages or failures, tropical storms or hurricanes, dangers of the sea, breakdown of machinery or equipment, riots or civil commotions or disturbances and any other acts of similar nature, theft, pilferage, sabotage, arrests, strikes or other labor disruptions, restraints of rulers or peoples, expropriations, acts of terrorism, war, insurrection, strikes, epidemics, restrictions, government health advisories or warnings or alerts of any kind or nature, acts of governments or other authorities de jour or de facto, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities, or by reason of any other cause or causes of any similar nature or any other factor unforeseen by GetAway Travel Group that impacts negatively on or hampers its ability to fulfill any of its contractual conditions. In the event that any of these conditions apply, GetAway Travel Group shall be excused, discharged or released from its performance to the extent such performance is so limited or prevented, without liability of any kind.

 

Miscellaneous

In the event any paragraph of these Terms and Conditions shall be declared invalid or void by any court, such declaration shall not invalidate the entire agreement and all other paragraphs of these Terms and Conditions shall remain in full force and effect. The parties agree any claim or litigation arising out of or relating to this these Terms and Conditions, or the breach or validity thereof, shall be brought in Guilford County, North Carolina, the location of GetAway Travel Group corporate offices, and the governing law shall be the laws of the State of North Carolina. You agree that in the event that any civil proceeding, arbitration, mediation or action of any kind, is commenced by you against GetAway Travel Group or any of its agents, affiliates, officers, assignees or employees, the limit on any damages [which includes but is not limited to damages, interest, court costs, attorney fees, expenses of litigation, and punitive damages] shall be the amount you paid GetAway Travel Group for the services which is the subject matter of these Terms and Conditions.

 

Methods of Contact

You authorize GetAway Travel Group to contact you from time-to-time via e-mail, phone or text message at the e-mail address or telephone number[s] provided by you when booking your reservation. Please note that message and data rates may apply. The purpose of the communications is to discuss the status of your travel products and/or services purchased by you, to tell you about additional products and services for which you may qualify and other business purposes. You may withdraw your consent at any time.

 

Responsibility and Limitation of Liability

Each of GetAway Travel Group, its agents and subagents' act as an agent for you in relation to travel services and/or products purchased by you including, but not limited to, accommodations, transportation [including, but not limited to, ground and air transportation], and tours. GetAway Travel Group makes no guarantees or warranties, express or implied, regarding any such services. This includes, but is not limited to transfers, flights, cruises, tours, services and accommodations purchased or provided, as well as other features listed or not listed in these Terms and Conditions and/or your itinerary.

All of these travel services and/or products purchased by you and provided in your itinerary are furnished by independent contractors over which GetAway Travel Group and its agents and subagents exercise no control. Although GetAway Travel Group has taken reasonable steps to ensure proper arrangements are in place for your travel plans, we cannot be held responsible for the acts or omissions of such independent contractors [including, but not limited to, delayed opening of hotel accommodations and any related relocations as a result of such delay. In such cases, you will be responsible for all costs and damages in connection with such delay and relocation including, but not limited to, airline fees and accommodation costs]. GetAway Travel Group, its parent, subsidiaries, affiliates, agents, subagents and each of their respective officers, directors, employees, agents and representatives shall not be liable for any injury, loss or damage whether mental, emotional or physical howsoever sustained, resulting or arising from any act, error, omission or negligence of any company or person, agent, employee or subcontractor supplying any of the travel services and/or products as part of your travel plans.

GetAway Travel Group, its parent, subsidiaries, affiliates, agents, subagents, suppliers and each of their respective officers, directors, employees, agents and representatives' liability for any loss, damage or injury, whether to property, physical or mental, arising from their own acts, omissions or negligence, is limited to the amount you paid to GetAway Travel Group for the services with respect to which you are claiming.

The sole and exclusive responsibility and liability of any airline used in GetAway Travel Group' services shall be in accordance with and limited by the contract of carriage on your ticket, the applicable tariffs, and the provisions of the Warsaw Convention or Montreal Convention, as applicable.

 

Hotel Check-in and Check-Out Conditions

The check-in time for most hotels is 3:00 pm and check-out time can be as early as 11:00 am, regardless of your arrival or departure times. Please refer to your hotel accommodation voucher for actual check-in and check-out dates as this may differ from your departure and return date. Check-in policies differ by hotel and will therefore vary. Many hotels will offer hospitality areas for travelers who may be without their room for some time; however, this arrangement is solely at the discretion of the hotel. Travelers wishing to make arrangements for a late check-out and baggage storage must arrange this service directly with the hotel. We do not accept responsibility for any inconvenience or loss arising from these types of arrangements. Some hotels may require you to leave a credit card imprint or cash deposit upon check-in to provide security for miscellaneous charges such as telephone calls.

 

Special Needs Travelers

Travelers with special needs who will require special services or assistance while traveling, including handicap adapted rooms and/or wheelchair accessible rooms, must advise GetAway Travel Group at the time of booking. In order to ensure that you are properly assisted, we request that you advise of any and all specific needs that you may have. Please contact us at 888-702-3339 for further assistance.

 

Hotel Substitution and Description

GetAway Travel Group assumes no liability for hotel overbookings resulting in inconvenience and/or substitute accommodations being provided, whether of a similar or lesser quality and location. Description of services included, and rates are based on inclusions/prices at print time and are subject to change without notice. GetAway Travel Group will not be responsible or liable if any of the services, features, or facilities described on this website or in the brochure cease to be available or fail for any reason. Any resort credits provided by a hotel are provided at the hotel's sole discretion and are subject to the hotel's terms and conditions. GetAway Travel shall not be held responsible for the use or non-use of the resort credits.

 

Hotel Package Cancellation

For most hotels, a $100 charge per person will apply if the cancellation is made 45 days prior to departure. If cancellation is made 31-44 days prior to departure, then a charge equal to 50% of package price will apply. If cancellation is made 30 days or less prior to departure, then a charge equal to 100% of package price will apply. If final payment is not received 45 days prior to departure, then GetAway Travel Group has the right to cancel your reservation without refund of any deposits. Notwithstanding the foregoing, GetAway Travel Group currently sells hotels that are non-refundable as indicated on our website and/or as advised by GetAway Travel Group. These hotels cannot be refunded if canceled after they have been booked. If you wish to purchase insurance for packages that include non-refundable rates, the only available plan from GetAway Travel Group is the Vacation Protection Insurance.

 

Reservation/Deposits

For most hotel-only reservations made more than 45 days prior to departure, a deposit in the amount of $100 per person is due to GetAway Travel Group by 5pm Eastern Time on the same day. The deposit amounts may change at any time without notice. Vouchers and/or credits cannot be used for a deposit on a reservation.

Groups, Early Booking Bonuses, bookings made during peak periods and other special bookings have different payment and cancellation policies.

For reservations involving scheduled air, payment for the value of the air ticket plus $100 deposit per person will be due by 5pm Eastern Time on the same day. For Charter Flights and Charter Packages, a deposit in the amount of $125 per person is due by 5pm Eastern Time on the same day if the reservation is made more than 45 days prior to departure.

 

Final payment for all reservations is due 45 days prior to departure. No checks are accepted less than 21 days prior to departure. Reservations made 45 days or less prior to departure require full payment at time of booking. If final payment is not received by the final payment due date, the reservation will be canceled, and no monies will be refunded to the client.

 

Bookings made that do not meet the deposit and final payment requirements set out in these terms and conditions will be cancelled without refund

 

Please note: Airfare is subject to change until tickets are paid in full and purchased.

Reduce Deposit Options
When selecting the reduce deposit option, the reduce deposit amount is non refundable, no refunds apply under any circumstance. You may purchase insurance to protect your vacation investment. Until you have paid in full for your airline ticket, your ticket won’t have any value, no changes can be made.

 

Groups

If you are traveling as part of a group of 15 or more adults, different deposit, payment and cancellation policies may apply. See your group contract for details.

 

Price

The package price, as indicated on your itinerary may include a flight as well as applicable airfare taxes, except for some destination’s departure tax. Other tour services and accommodations are included in your package price only if they are indicated on your itinerary. These package inclusions/rates are based on inclusions/prices at print time and are subject to change without notice.

All reservations are locked into the price published once booked. From time to time, GetAway Travel Group may offer discounts or special offers. Such discounts and special offers are applicable to new reservations only and may not be applied to an existing reservation. If you choose to cancel your existing reservation and make a new reservation, the deposit from the cancelled reservation will not be refunded and cancellation fees will apply as set out below.
